Welcome to Mad-ly! These Terms of Service ("Terms") govern your access to and use of our website at mad-ly.com, our online store, and any related services (together, the "Site"). By visiting, browsing, or making a purchase on the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Our company

2. Use of the Site

You may use the Site only for lawful purposes and in line with these Terms. You agree not to:

use the Site in any way that violates federal, state, or local law;
try to gain unauthorized access to any part of the Site;
transmit harmful code, viruses, or disruptive material; or
copy, reproduce, or scrape content from the Site without our permission.

3. Products, pricing, and orders

All prices are in U.S. dollars and may change without notice.
We may refuse or cancel any order for any reason, including pricing errors or product availability. If we cancel your order, we'll let you know and issue a full refund.
We show colors, sizes, and descriptions as accurately as we can, but slight variations may occur. Our skateboard wall art is made from real maple, so sizes can vary slightly and a little natural wood grain may show. Designer Series boards are handmade to order, so each one is unique.
Our skateboard decks are wall art for display only and are not meant for skating.
Placing an order is an offer to purchase; we accept it when we ship your item(s).

4. Shipping and delivery

We ship to all U.S. addresses, including Alaska, Hawaii, U.S. territories, and military (APO/FPO/DPO) addresses. Standard shipping is free on all U.S. orders. An optional, faster Express option is also offered at checkout ($5, or free on orders of $100 or more). Processing and delivery times are listed in our Shipping Policy (linked in the footer).
Title and risk of loss pass to you when we hand your order to the carrier. This doesn't affect our promise to replace or refund wall art that arrives damaged, as described in our Refund & Return Policy.
We're not responsible for delays caused by the carrier.

5. Returns and refunds

Please see our full Refund & Return Policy (linked in the footer). In short:

You have 7 days from receipt to start a return through our Returns Portal, and you cover return shipping.
You can add optional Redo return protection at checkout, which helps cover return costs. See the Refund & Return Policy for details.
Wall art: report damage in transit within 3 days of delivery with a photo, and we'll replace the board or refund it in full. Undamaged boards must be unused, unaltered, returned with all mount hardware, and sets must be returned complete. Designer Series boards are handmade to order and can't be returned for a change of mind (damage or defects are still covered).
Clothing and accessories: items must be unworn, with all original tags attached. Swimwear must also have any hygiene liner still in place.
Approved returns are refunded the product total minus a $10 shipping/handling fee (damaged or defective items are refunded in full).
Exchanges are encouraged when available.

6. Intellectual property

All content on the Site, including text, images, logos, graphics, and product designs, is owned by Mad-ly LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any of it without our prior written consent.

7. User accounts

If you create an account, you're responsible for keeping your login information confidential and for all activity under your account. Please tell us right away about any unauthorized use.

8. Payments and billing

We accept major credit cards and the other payment methods shown at checkout. By providing payment information, you confirm you're authorized to use that method. All payments are processed securely.

9. Limitation of liability

To the fullest extent permitted by law, Mad-ly LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products. Our total liability will not exceed the amount you paid for the specific product(s) in question.

10. Disclaimers

Except as stated in our Refund & Return Policy, the Site and all products are provided "as is" without warranties, express or implied, to the fullest extent permitted by law. We don't guarantee the Site will be error-free or uninterrupted.

11. Indemnification

You agree to indemnify and hold Mad-ly LLC harmless from any claims, losses, or damages arising from your violation of these Terms or your use of the Site.

12. Changes to these Terms

We may update these Terms from time to time. We'll post the new version on this page with an updated "Last updated" date. Continuing to use the Site after changes means you accept the new Terms.

13. California Proposition 65

California law requires us to inform you that certain products sold on this website may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.

14. Governing law

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the state or federal courts located in the county of our principal place of business in Kansas.
